Judge Rules in Pipeline Eminent Domain Case; Property Owner Plans Appeal


(WBRE/WYOU)    How far can the power of eminent domain go?
          A federal judge ruled in favor of a natural gas pipeline company that sought to take some land using that tactic this afternoon.


Part of a 200-mile natural gas pipeline will soon be running through Ryan Regec 78-acres near Pine Grove, Schuykill county.
    Regic refused to let surveyors allow Williams and Trans Continental Pipeline’ access to his property in order to get the building permits they needed..

” Counter claimed and they stopped negotiations all in one.” said property owner Ryan Regec.

    Today a federal judge in Williamsport heard Regec’s claim – and rejected it. Granting the company, through eminent domain. Full rights to build that section of the ‘Atlantic Sunrise Project’ pipeline on Regec’s property.
“They have seized my entire property. They gave full rights to Williams.” Said Regec.

    The project manager declined to comment after the hearing, but a spokesperson for ‘Williams’ sent us this statement, which says 
“The use of eminent domain is only used as a last resort when all other attempts to negotiate an agreement fails.”
    The fight is isn’t over..

“The way Williams has been going about the process is essential a land grab and it’s not right.” added Deirdre Lally of the Clear Air Council.

    Deirdre Lally is part of a non-profit in Bloomsburg called the  ‘Clean Air Council” .
“I came here today to support the landowners that have chosen to take their fight to the federal courts.” said Lally
“I have put across cue! To them that I did not want the pipeline I never did.” noted Regec

Ryan Regec will be appealing the judge’s decision.
            He tells Eyewitness News  his property is now and will be land locked once construction starts in August
