The Law and You July 3, 2013
Q. They are putting up a new building next to my house. The workers start at 6 am and they play loud music all day long, their trucks
are parked everywhere and they even block my driveway. What can I do?
A. In Pennsylvania everyone has the right to the use and enjoyment of your property without interference from your neighbor. Right now, under what you have described, your neighbor would be creating a temporary nuisance under the law. A nuisance, very simply means that your neighbor is doing something on his or her property that is preventing you from using your property. The loud music, the noise and the blocking of your driveway. All of these things would allow you to pursue a civil action against your neighbor for money damages and to also make modifications to the noise and traffic so as to not interfere with your property rights.
