Luzerne County Family Pushes For Tougher Penalties For Hit And Run Drivers

It would be called Kevin's Law and would increase mandatory minimum sentences in cases in which drivers flee the scene of crashes. The law is named in honor of 5 year old Kevin Miller who was killed by a hit and run driver in Wilkes-Barre in 2012.
Caroline Miller says she will never forget what she saw on the night of December 21 2012 when her five year old son Kevin was hit and killed by a car driven by Thomas Letteer Junior of Plains Township. Letteer  fled the scene-- Prosecutors believe Letteer was drunk but they could not prove in in court- Letteer was sentenced to 2 to 5 years in prison but could have faced only one year under current state law- He would have faced a mandatory minimum of three years in prison had he been convicted of the charge of Homicide by Vehicle D-U-I--letter would have faced a mandatory minimum of three years. The Miller family was joined by state lawmakers Tuesday in the rotunda of the Luzerne County Courthouse in a show of support for Kevin's Law-- Caroline Miller said, "I witnesses the law in all of its reprehensible action and I will live with what I saw and experienced the rest of my life--"  State Senator John Yudichak (D) 14th District said, "I'm hear as a father to support you in your loss and it is clear from Kevin's case the loophole in Pennsylvania's hit and run law allows criminals to escape justice presenting no peace to a grieving family."  Luzerne County District Attorney Stefanie Salavantis added, "The affect of different mandatory minimum sentences continues to encourage to leave flee the scene."    There have been several attempts to increase mandatory minimum to at least three years in all hit and run cases but they al failed-- Opponents say too many mandatory minimum sentences will contribute to overcrowding in the prison system which is already stretched to the limit--- Lawmakers are confidents the law can be changed this time around
