Jury Seated in Scholl Case

Mother facing attempted murder

  WILKES-BARRE, LUZERNE COUNTY (WBRE/WYOU) Prosecutors say Melissa Scholl ran a hose from the exhaust pipe of her car into the passenger compartment in an attempted double murder-suicide about 18-months ago.
  Jury Selection is underway at the courthouse to hear a case that shocked  many in the area.

Scholl insisted all along that she was not trying to killer her kids - or herself. Prosecutors say they can prove otherwise.

Melissa Scholl is brought into the Luzerne County Courthouse Tuesday morning.

The 33 year old Wilkes-Barre Township woman says nothing as she is led to the elevators to be taken to the their floor courtroom.
Her story begins on the night of December 9th, 2015.

Detectives say she parked her car in the parking lot of a bus company and ran hoses from her car's exhaust pipe into the vehicle.  Her 7 year old son and 5 year old daughter were in the car. 

A bus driver returning from a run that evening spotted the car and intervened, stopping the alleged murder-suicide attempt.

Scholl's lawyers argue that she had no intention of harming herself or her children.
They claim that Scholl's mother was supposed to pick up the children and Scholl was simply waiting for her to arrive.
 
    The case took a surprising turn 10  months after her arrest when it was learned that Scholl's car,  a 2001 Saturn ,  a significant piece of evidence - had been  destroyed by the towing company.

 The company says it was given permission too destroy the car.

The state police say they never gave them that permission.

Defense lawyers wanted the attempted homicide charges dropped claiming the car was no longer available to be used at trial. They also claimed that the two hoses used to put the exhaust into the vehicle had been washed. A judge refused to drop the charges.

Opening statements tomorrow at 9:15., a jury of 9 men and three women seated to hear the case. There are two alternate jurors
