Melissa Scholl Re-trial Begins

LUZERNE COUNTY (WBRE/WYOU) Testimony is underway in a case that shocked many people across the region. Prosecutors say they will prove that Scholl wanted her two kids dead. But her defense lawyer insists she had no evil plan- it was simply a cry for help"

Defense Lawyer Larry Kansky set the tone of this re-trial immediately, making a motion to dismiss the attempted murder charges claiming that a County Detective lied during a hearing last year.

 Prosecutors  said the claim was ridiculous and asked why it took so long for these accusations to be made.

Judge Lupas denied the motion and scolded Kansky for slamming items on the defense table and shouting in the courtroom.

Investigators say on  the night of December 9th, 2015  Scholl put her 7 year old son and 5 year old daughter into her car and parked in a bus company parking lot on Blackman Street in Wilkes-Barre Township.

She allegedly ran two garden hoses into the car to kill them and herself. A bus driver happened along the scene and stopped the attempt.

Prosecutor Angela Sperazza told the jury.  "Melissa Scholl calculated a plan to kill herself and her two children because she couldn't handle being a single parent."

 She added "Her own son told her not to kill her self. Those kids didn't have a choice that night."

 Defense lawyer Larry Kansky fired back telling the jury:  "She had no intent to kill her children. This was a dramatic display to get the attention of her family. This was a cry for help. "

 And added "This was a botched police investigation of epic proportions"

The trial will continue tomorrow.
